1. Acceptance of Terms

Welcome to Oakhaven. These Terms and Conditions ("Terms") govern your use of our website and participation in our financial education programs. By accessing our website or enrolling in our programs, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, please do not use our services. We reserve the right to update these Terms at any time. Your continued use of our services following any changes constitutes acceptance of the modified Terms.

2. Definitions

For the purposes of these Terms:

• "We," "Us," "Our" refers to Oakhaven, a financial education provider operating in Bangkok, Thailand
• "You," "Your," "Participant" refers to individuals who use our website or enroll in our programs
• "Programs" refers to our educational offerings including Seeds of Financial Literacy, Growing Your Investment Knowledge, and Legacy & Continuity Planning
• "Services" refers to our website, programs, and related educational activities
• "Content" refers to all information, materials, and resources provided through our Services

3. Eligibility

Our programs are designed for adults aged 18 years or older. By enrolling, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

If you are enrolling on behalf of an organization or in a representative capacity, you warrant that you have the authority to bind that entity to these Terms.

4. Program Enrollment and Participation

4.1 Registration

To enroll in a program, you must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

4.2 Program Completion

Participation in programs requires attendance at scheduled sessions and completion of program activities. We reserve the right to modify program schedules with reasonable notice to participants.

4.3 Program Materials

Program materials are provided for your personal educational use and may not be copied, distributed, or commercially exploited without our written permission.

5. Payment Terms

5.1 Fees

Program fees are stated in Thai Baht (THB) and include:

• Seeds of Financial Literacy: ฿10,500
• Growing Your Investment Knowledge: ฿31,000
• Legacy & Continuity Planning: ฿67,000

All fees include program materials and resources. No additional charges will be imposed without prior notice.

5.2 Payment Methods

We accept payment via bank transfer and major payment processors. Full payment is required before program commencement unless alternative arrangements have been agreed in writing.

5.3 Refund Policy

Refund requests must be submitted in writing to [email protected]. Our refund policy is as follows:

• Cancellation more than 14 days before program start: Full refund minus 10% administrative fee
• Cancellation 7-14 days before program start: 50% refund
• Cancellation less than 7 days before program start: No refund
• After program commencement: No refund for unused sessions

Exceptions may be made for medical emergencies or other exceptional circumstances at our discretion.

6. Educational Nature of Services

6.1 Not Financial Advice

Our programs provide financial education and information. We do not provide personalized financial advice, investment recommendations, or tax guidance. You should consult qualified professionals for advice specific to your circumstances.

6.2 No Guarantees

We do not guarantee specific outcomes, returns, or results from participating in our programs. Financial decisions remain your responsibility. Past examples or case studies do not predict future results.

6.3 Product Independence

We maintain independence from financial product providers and do not receive commissions or compensation for product referrals. Information about financial products is provided for educational purposes only.

7. Intellectual Property

All content, materials, trademarks, and intellectual property associated with our Services remain the exclusive property of Oakhaven. This includes program curricula, teaching materials, website content, and branding.

You are granted a limited, non-exclusive, non-transferable license to access and use program materials solely for personal educational purposes. You may not:

• Reproduce, distribute, or publicly display our materials
• Create derivative works based on our content
• Use our materials for commercial purposes
• Remove or alter copyright notices or attributions

8. User Conduct

As a participant, you agree to:

• Respect the learning environment and other participants
• Maintain confidentiality of other participants' shared information
• Use program materials responsibly and as intended
• Provide accurate information during registration and participation
• Comply with all applicable Thai laws and regulations

You agree not to:

• Engage in disruptive or disrespectful behavior
• Misuse or distribute program materials
• Violate the privacy or rights of other participants
• Use our Services for any unlawful purpose

We reserve the right to remove participants who violate these conduct standards, without refund.

9. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and Thai data protection law (Personal Data Protection Act, PDPA). By using our Services, you consent to such processing as described in our Privacy Policy.

10. Disclaimers and Limitation of Liability

10.1 Service Provision

Our Services are provided "as is" without warranties of any kind, either express or implied. While we strive for accuracy and quality, we do not warrant that our programs will be error-free, uninterrupted, or meet your specific expectations.

10.2 Financial Decisions

You acknowledge that financial decisions involve risk and that you are solely responsible for your financial choices. We are not liable for any financial losses, damages, or consequences resulting from decisions you make based on program content.

10.3 Limitation of Liability

To the maximum extent permitted by Thai law, our total liability to you for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid for the relevant program.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or opportunities, even if we have been advised of their possibility.

11. Indemnification

You agree to indemnify and hold harmless Oakhaven, its educators, and affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of program materials or Services
• Your violation of any rights of third parties
• Your financial decisions or actions

12. Program Modifications and Cancellations

We reserve the right to modify program content, schedules, or educators as necessary. We will provide reasonable notice of significant changes.

In rare cases, we may need to cancel a program due to insufficient enrollment or unforeseen circumstances. If we cancel a program before commencement, you will receive a full refund. If cancellation occurs after commencement, you will receive a pro-rated refund for undelivered sessions.

13. Termination

We may terminate or suspend your access to our Services immediately, without prior notice, if you breach these Terms or engage in conduct we deem inappropriate or harmful.

Upon termination, your right to use our Services ceases immediately. Provisions regarding intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Thailand. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts in Bangkok, Thailand.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Oakhaven regarding use of our Services.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 Language

These Terms are provided in English. If translated, the English version shall prevail in case of any inconsistency or dispute.

16. Changes to Terms

We may modify these Terms at any time by posting the updated version on our website with a new "Last Updated" date. Material changes will be communicated via email to enrolled participants.

Your continued use of our Services after changes are posted constitutes acceptance of the modified Terms. If you do not agree with the changes, you should discontinue use of our Services.
